Terms of use

The agreement between you and [COMPANY LEGAL NAME, S.L.] for your use of NOXX.

Last updated: [DD MONTH YYYY]

Draft — not yet in force. This page is awaiting company details (company name, tax ID, registered address, company registry, contact email, privacy email, hosting provider, database provider, last updated) and review by a qualified lawyer. Anything shown in square brackets is a placeholder.

1. Who you are contracting with

NOXX is operated by [COMPANY LEGAL NAME, S.L.], tax ID [CIF / NIF], registered in Spain. Full identification details are on the Aviso legal page. “We”, “us” and “our” mean that company; “you” means the person using the service.

2. Acceptance

By creating an account or using NOXX you accept these terms. If you do not accept them, do not use the service. If you are using it on behalf of an organisation, you confirm you may bind that organisation.

3. What the service is

NOXX provides:

  • a calendar of scheduled economic releases, with countdowns and impact ratings, drawn from third-party sources;
  • trading session hours, overlap windows and related clocks;
  • a globe and related views presenting that same information visually;
  • a private journal in which you record your own trades, notes and screenshots, and statistics computed from what you entered.

The service is informational. It does not connect to a broker, place or manage orders, hold money or financial instruments, or verify anything you enter.

4. Not investment advice

Nothing in NOXX is investment advice, a personal recommendation, or an offer or solicitation to deal in any financial instrument. We are not an investment firm and are not authorised by the CNMV or any other financial regulator. The full risk statement at the foot of this page forms part of these terms.

5. Your account

You need an account to use the journal. You must give an email address you control, keep your credentials confidential, and tell us promptly if you believe your account has been accessed by someone else. You are responsible for activity under your account. One person, one account — do not share it.

You must be at least 18 years old to use NOXX.

6. Early access

NOXX is in early access and free to use. Features may change, break or be withdrawn, and availability is not guaranteed. We may introduce paid plans in future; if we do, we will say so in the application before any charge arises, and you will never be charged without agreeing to it first.

7. Your content

Your trades, notes and screenshots remain yours. You grant us only the permission needed to operate the service — to store that content, show it back to you, and back it up. We do not sell it, publish it, or use it to train models. You are responsible for having the right to upload what you upload.

You can export or delete your data at any time by contacting us at [privacy@example.com]. Deleting your account removes your content, subject to the retention described in the Privacy policy.

8. Acceptable use

You agree not to:

  • scrape, resell or systematically extract market data from the service;
  • attempt to access another user’s account or data;
  • probe, overload or interfere with the service or its infrastructure;
  • upload unlawful content, malware, or anything infringing someone else’s rights;
  • present the service, or output from it, as regulated financial advice.

We may suspend or close an account that breaches this section.

9. Third-party data and services

Economic calendar data comes from third-party providers. We do not control it, cannot guarantee its accuracy or timeliness, and may change provider or lose access to a feed without notice. When a feed is unavailable the application says so rather than showing stale or estimated figures.

10. Availability and changes

We aim to keep the service running but do not promise uninterrupted availability. We may modify, suspend or discontinue any part of it. Where a change materially reduces what the service does, we will give reasonable notice through the application or by email.

11. Liability

To the fullest extent permitted by law, we are not liable for trading losses, lost profits, lost opportunity, or any indirect or consequential loss arising from your use of NOXX — including losses arising from inaccurate, delayed or missing market data. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

If you are a consumer, your statutory rights under Spanish and EU consumer law are not affected by these terms.

12. Ending the agreement

You may stop using the service and close your account at any time. We may terminate or suspend access if you materially breach these terms, or if we discontinue the service. Sections that by their nature should survive — content ownership, liability, governing law — survive termination.

13. Changes to these terms

We may update these terms. The date at the top shows the current version. For material changes we will notify account holders by email or in the application before they take effect. Continuing to use the service after that constitutes acceptance.

14. Governing law

These terms are governed by Spanish law. Disputes shall be submitted to the courts of [CITY], Spain, except where a mandatory consumer-protection rule gives a consumer the right to bring proceedings before the courts of their own domicile. Consumers resident in the EU may also use the European Commission’s online dispute resolution platform.

Information, not investment advice

NOXX is an information and record-keeping tool. Nothing it shows — economic calendars, countdowns, session clocks, charts, journal statistics or any other output — is investment advice, a personal recommendation, a solicitation, or an offer to buy or sell any financial instrument. We do not provide portfolio management, brokerage or any regulated investment service, and we are not authorised by the CNMV or any other financial regulator to do so.

Market data is supplied by third parties and may be delayed, incomplete or wrong. Do not rely on it for trading decisions. Figures you enter yourself are stored as entered and are never verified against a broker.

Trading leveraged instruments such as forex and futures carries a high risk of losing money rapidly. Past performance — including anything shown in your own journal — does not predict future results. You alone are responsible for your trading decisions, and you should seek independent, licensed advice before acting.
